Los Angeles–Twenty-three days short of Arizona’s anti-immigrant law (SB1070) is set to go into effect, the Department of Justice (DOJ) announced today it will challenge the State of Arizona in court.  Secretaries Holder and Napolitano announced the lawsuit is based on the premise that federal law supersedes state statute.  The following is a statement by Angelica Salas, Executive Director of the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA), a regional human and immigrant rights not-for-profit community-based organization based in Los Angeles.

"Today, the federal government reasserts its right to enact, implement, and defend the laws of the land.  We view the challenge to Arizona’s SB1070 as an important first step in our nation’s ongoing struggle to defeat racism and intolerance.

Arizona’s SB1070 is a crude attempt at circumventing federal law in the name of national security.  The toughest anti-immigrant law in the land goes beyond codifying racial profiling of immigrants and people of color; it endangers the rights of every American.  SB1070 does nothing to solve our nation’s immigration crisis. 

The DOJ is calling Arizona’s bluff and in the process adding a layer of pressure on Arizona’s leadership to reject SB1070 and prevent it from going into effect later in July.  As the DOJ sets up its case against Arizona, we will continue to pressure Congress to enact real, humane, and workable immigration reform.

"Hoy, el gobierno federal intenta restablecer su derecho fundamental a redactar, implementar, y defender leyes que rigen a esta nación.  El reto legal a la SB1070 es un paso sumamente importante en la lucha en contra del racismo y la intolerancia.  

La ley de Arizona es un intento vulgar de adaptar leyes federales de inmigración y hacerlas cumplir localmente en nombre de la protección del público en general.  La SB1070 es la ley más severa en contra de los inmigrantes porque codifica el perfilamiento racial de los inmigrantes y la gente de color.  Además de hacer peligrar los derechos constitucionales de todo estadounidense esta ley no resuelve el grave problema de leyes de inmigración quebrantadas. 

La demanda del DJ desenmascara al estado de Arizona y agrega más presión legal para que el liderazgo de ese estado rechace la ley y detenga su aplicación este fin de julio.  Al mismo tiempo que el DJ establece su argumento en contra de Arizona, la comunidad debe continuar presionando al Congreso para que se apruebe una reforma migratoria justa y humana”.
